GENERAL TERMS AND CONDITIONS OF SALE – ETAPpro Europe

1. Purpose and scope

These GTC govern sales made on the ETAPpro Europe website to consumers and, where compatible with their status, professional customers. Any order implies their unreserved acceptance.

2. Seller identity

3. Products and offers

The Site notably sells ETAPpro chargers, wall brackets, cables, adapters, accessories and bundles. The customer must check the technical characteristics, power, plug type and compatibility with their vehicle and electrical installation. Accessories are included only when expressly mentioned.

4. Prices

Prices are those displayed at the time of the order. They are stated in euros, all taxes included, for consumers, unless otherwise indicated. Delivery costs and any other fees are shown before final validation.

5. Order

The customer checks their basket, contact details and address. The order becomes firm after acceptance of the GTC, validation of payment and sending of the confirmation. The seller may refuse an order for legitimate reasons, in particular fraud, non-payment, manifestly incorrect information or definitive unavailability.

6. Payment

The means actually offered at the time of the order may include bank card, transfer and any other displayed means. In the case of a transfer, preparation begins after receipt of funds. The products remain the property of the seller until full payment.

7. Delivery

Delivery generally takes place within an indicative period of about 14 days. Unless a different period is clearly announced and accepted, or in a case of force majeure, it takes place no later than 30 days after conclusion of the contract. In the event of delay, the consumer rights provided by the Consumer Code remain applicable.

8. Installation

Installation is not included in the displayed price, unless otherwise stated in writing. Depending on the location and characteristics of the electrical installation, ETAPpro Europe may offer a separate study and quote. The seller is not liable for damage resulting exclusively from incorrect installation carried out by a third party, a non-compliant network or failure to follow the instructions.

9. Right of withdrawal

The consumer has a period of 14 days from receipt of the goods to exercise their right of withdrawal, without having to give reasons. They notify their decision by an unambiguous statement or by means of the appended form. Legal exceptions, in particular for personalised products, remain applicable. This right does not apply automatically to professional purchases.

10. Returns and refunds

After notification of withdrawal, the consumer returns the product within the legal period, complete and properly protected. Direct return costs may remain their responsibility in the case of a simple change of mind. They are borne by the seller in the case of an error, a recognised defect or non-conformity. The refund is made in accordance with the legal deadlines and may be deferred until the goods are recovered or proof of dispatch is received.

11. Legal guarantee of conformity and hidden defects

The consumer benefits from the legal guarantee of conformity for 2 years from delivery of the goods, as well as the guarantee against hidden defects under the conditions provided by law. Any commercial or manufacturer warranty is added to these rights without replacing them.

12. Liability

The seller is responsible for the proper performance of its obligations. Its liability cannot be engaged when the damage results directly from a fault of the customer, incorrect information, use contrary to the instructions, a non-compliant installation, unauthorised intervention or a case of force majeure. No clause limits a mandatory consumer right.

13. Complaints, after-sales service and mediation

Complaints are addressed to hello@etap-pro.com. The customer provides the order number and relevant details. After a prior written complaint that has remained without solution, the consumer may use the consumer mediator free of charge, whose details will be indicated here: [Mediator being validated.].

14. Personal data

Data is processed for the management of accounts, orders, payments, deliveries, after-sales service, security and legal obligations, in accordance with the GDPR and the French Data Protection Act. The rights of access, rectification, erasure, restriction, objection and portability may be exercised at hello@etap-pro.com. The customer may also refer the matter to the CNIL.

15. Applicable law and disputes

These GTC are subject to French law. In the event of a dispute, the parties first seek an amicable solution. The consumer may bring the matter before the competent court according to the applicable protective rules. For professionals only, a jurisdiction clause in favour of the court of the seller registered office may be agreed when valid and clearly accepted.
