GENERAL TERMS AND CONDITIONS OF USE – ETAPpro Europe

1. Purpose

These GTU define the terms of access and use of the ETAPpro Europe website. They apply to any visitor, user and account holder.

2. Access to the site

The Site is accessible subject to maintenance operations, technical incidents, security requirements and cases of force majeure. The publisher may temporarily suspend all or part of the Site when necessary, without guaranteeing continuous availability.

3. Customer account and security

The user must provide accurate information and keep their contact details up to date. They protect their credentials and immediately inform the publisher of any unauthorised use. They are responsible for operations carried out from their account except in the case of fraud or a failure attributable to the publisher.

4. Intellectual property

The ETAPpro brand, logos, texts, photographs, videos, technical sheets, interfaces, software, databases and other content of the Site are protected. Any unauthorised reproduction, extraction, adaptation, distribution or exploitation is prohibited, except for a legal exception or prior written agreement.

5. Prohibited uses

The user refrains in particular from disrupting the Site, introducing malicious software, circumventing security devices, massively extracting data, impersonating an identity, misusing the Site for fraudulent purposes or publishing illegal content.

6. Liability

The technical information published is general and does not replace a diagnosis carried out by a qualified professional. The user must check the compatibility of the products with their vehicle and installation. The publisher is not liable for damage arising from misuse, non-compliant installation, incorrect information provided by the user, a third-party service or an unforeseeable external event. The limitations do not apply where they would be contrary to a mandatory rule.

7. Personal data and cookies

Data is processed in accordance with the GDPR and the French Data Protection Act for the management of accounts, orders, contact requests, security, statistics and legal obligations. The user may exercise their rights of access, rectification, erasure, restriction, objection and portability at hello@etap-pro.com. Cookies that are not strictly necessary are placed after obtaining consent where required.

8. Hyperlinks and third-party services

The Site may offer links or integrate payment, delivery, mapping or social network services operated by third parties. ETAPpro does not permanently control these services and is not responsible for their content or availability, subject to its own obligations.

9. Reviews and content published by users

Where the Site allows a review or content to be published, the user guarantees that it is lawful, sincere and does not infringe the rights of third parties. The publisher may remove content that is manifestly unlawful, fraudulent, insulting, advertising or unrelated to the product concerned.

10. Suspension or deletion of an account

The account may be suspended or deleted in the event of fraud, abuse, breach of security, serious violation of the GTU or legal obligation. The user is informed when circumstances and the law permit.

11. Modification of the GTU

These GTU may be modified to take account of a legal, technical or functional change. The version in force is published on the Site. Significant changes concerning account holders may be notified to them.

12. Applicable law and disputes

These GTU are subject to French law. The parties first seek an amicable solution. Failing this, the competent courts are determined according to the applicable legal rules, without depriving the consumer of their protections.
